Bankruptcy issues in divorce cases

Judge Kevin R. Anderson, U.S. District Bankruptcy Judge, will be at the class that is free for attorneys volunteering to take a pro bono case during the year or attorneys who are willing to help at one of our clinics. If you cannot volunteer at this time, we suggest a $50 donation to Timpanogos Legal Center. To register, email [email protected] with your name, bar number, email and phone and whether you will attend in St. George or Cedar City.

Opportunities to volunteer with TLC

The TLC document clinic is online so you don’t need to leave your office to help the client. TLC pre-screens the clients. Clients must be self-represented. Clients sign a “Limited Scope Representation Agreement” allowing volunteer attorneys to help the client draft documents relating to divorce/custody cases (examples include Temporary Orders, Orders to Show Cause, Motions for Alternate Service and Petitions to Modify). Attorneys set the time to meet with clients at their convenience.

Our staff sets up the appointment with the client and sends the attorney and the client the link to meet online. When possible, we also line up a law student to assist with the drafting. The attorney clicks on the link in the email and the attorney will automatically join a virtual session in which the client, volunteer attorney, the law student and the TLC attorney can all see each other. There is no need to download anything and there are no passwords. During the clinic, the documents are prepared and emailed to the client.

The representation ends when the documents are complete. The program coordinator may follow up to make sure the client didn’t run into barriers when filing the documents and arranging for service of process. Volunteers receive templates and guidance from TLC attorneys. There is a TLC attorney available to offer suggestions and advice, so even if you don’t have experience in family law you will be successful in helping the client.

Participating in the document clinic is a great opportunity to make a substantial difference in the life of a client without having to commit to ongoing representation.

Domestic violence shelter clinics

We host several monthly walk-in legal clinics in the Southern Utah area. One is held at Canyon Creek Crisis Center in Cedar City. It is on the first Thursday of the month from 4-6:00 p.m. Our St. George legal clinic is hosted at the St. George Public Library, and is held the first Monday of the month from 10:30 a.m. until 12:30 p.m. Attorneys give advice on victim’s rights, referrals to legal programs that can provide services, referrals to other victim services, provide help in accessing crime victim reparations funds, explain the differences between court processes, answer questions about divorce and custody cases, and screen the clients for the document clinic. TLC attorneys provide training and mentoring. There are handouts prepared for the clients on all of these topics.

If you have any questions, please contact Julene Curtis, Victim Advocate, Timpanogos Legal Center at [email protected]. To volunteer, please email [email protected] or call our hotline at (801) 649-8895.

If you want to refer a client to TLC, they should call the hotline or email [email protected] Attorneys are available to answer questions between 9:00 a.m. and 2:00 p.m., Monday through Friday.
