CEDAR CITY — A Cedar City man was arrested Monday night after allegedly firing a handgun during a confrontation with a neighbor.

Jonathan Koltvet, 40, was booked into Iron County Jail following the incident, which reportedly occurred at approximately 9:20 p.m. at a residence near 300 West and 2100 North.

According to the probable cause statement filed on Tuesday in support of Koltvet’s arrest, one of his neighbors had gone to Koltvet’s home to confront him about an unspecified issue. Koltvet told officers the other man had come into the garage and began aggressively yelling at him.

“He said he pulled out a gun and told the victim to leave,” the affidavit states. “The victim then walked up to him and put his head against the gun. Jonathan said he shot past the male, intentionally aiming over a retaining wall in the parking lot.”

According to the affidavit, Koltvet fired a single shot from the weapon, which was identified as a Springfield Hellcat.

Cedar City Police Lt. Jimmy Roden told Cedar City News the other man told investigators he had heard the bullet go past his head.

“Then, a third party witness who was on scene had to help defuse it and separate the two and remove the suspect from the scene,” Roden said.

The gun later was recovered from a room inside Koltvet’s residence, the affidavit states.

After going back inside, Koltvet reportedly made dinner then went out to his garage to smoke, “expecting us to come over at some point,” the arresting officer wrote. Koltvet did not make an attempt to call the police to notify them about what occurred, the report said.

Shortly before midnight, Koltvet was booked into Iron County Jail on suspicion of aggravated assault and felony discharge of a firearm, both of which are classified as third-degree felonies.

A search of Utah court records revealed no significant criminal history for Koltvet. The only charge listed under his name was a traffic citation for which he was fined $210 in January of this year.

This report is based on statements from court documents and law enforcement officials and may not contain the full scope of findings. Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
