5 sentenced in Cedar City Home Depot theft case

CEDAR CITY — The five people who were arrested for stealing some $4,500 worth of merchandise from The Home Depot in Cedar City on Valentines Day were all recently sentenced, each after having pleaded guilty to one count of theft.

As previously reported in St. George News / Cedar City News, the group was seen leaving the store the afternoon of Feb. 14 with merchandise they hadn’t paid for. Some time later, police arrested them as they were getting gas at a convenience store just off the Hamilton Fort exit of Interstate 15, a few miles south of Cedar City.

All five defendants, who were reportedly from Nevada, were sentenced separately last week by 5th District Judge Ann Marie McIff Allen. 

Two of the defendants received lesser sentences after their charges were reduced. Davonte Deshay Byers, 26, and Shakila “Sha” Alexandra Kaaihue, 23, each pleaded guilty to a single count of theft, a class A misdemeanor. Both were ordered to serve 10 days in jail with credit given to time already served. They were also placed on probation for 24 months and each ordered to pay $553 in fines and fees, payable in monthly installments of $50.

The other three defendants, Chad Manu Kaaihue, 21, Jordan Isaiah Byers, 23, and Kenvin Michael Fauria, 23, each pleaded guilty to one count of third-degree felony theft, punishable by zero-to-five years in prison.  

In all three of those cases, the court suspended the prison term and ordered that the defendants each serve a total of 45 days in jail, with credit given for time served since their Feb. 14 arrest. They also were each ordered to pay $1,053 in fines and fees, payable in monthly installments of $50. The trio were also given 36 months of probation, starting when they are released from jail.
