KANE COUNTY – A former manager at Wendy’s restaurant in Kanab, arrested in April for having sexual relations with a 16-year-old Wendy’s employee, was arraigned on July 23 and is scheduled to be sentenced in October.
Shalene May Lathim, 47, of Fredonia, Arizona, was arrested April 22 on two counts of first-degree felony forcible sodomy and one count of first-degree felony rape. Lathim was also charged with one third-degree felony for dealing in harmful material to a minor, related to sending sexual images to the 16-year-old boy.
Lathim and a teenage boy, who was also a Wendy’s employee and 16 years old at the time the incidents occurred, began texting each other, which later evolved into sexting, according to court documents. The two then met on two separate occasions at a location near Wendy’s to have sexual relations in Lathim’s car.
On April 21, an anonymous tipster informed a Kanab City Police officer that Lathim had sent a nude photo of herself via Snapchat to the 16-year-old boy, according to a probable cause statement filed in support of Lathim’s arrest. The 16-year-old then texted the photo, which showed Lathim topless and wearing only panties, to the tipster’s cellphone.
The informant told the officer that Lathim had performed oral sex twice on the 16-year-old and had intercourse with him once.
With his father present, the 16-year-old was later interviewed at the Department of Child and Family Services in Kanab.
“During the interview,” the officer wrote in the probable cause statement, “(the teen) stated that he and Lathim started out by texting each other and evolved to ‘sexting’ and exchanging several nude pictures, a few video’s (sic), one which includes Lathim Masturbating (sic).”
After working a shift at Wendy’s in early April, the teen stated in the interview, he followed Lathim to a location not far from the restaurant, parked, got out of his car and got into Lathim’s vehicle. The two then engaged in intimate acts, including Lathim performing oral sex on the teen.
On the second occasion, according to the statement, the teen followed Lathim to “a more secluded spot.” He again got into her car, where she performed oral sex on him and the two then engaged in sexual intercourse.
On April 22 at about 10 p.m., the arresting officer was notified by dispatch that Lathim was in the lobby of the Kane County Sheriff’s Office and wanted to speak to an officer. The officer responded and read Lathim her Miranda rights. She said she wanted her lawyer present, according to the statement, and was then placed under arrest.
Lathim was booked into the Kane County Jail with a listed bail amount of $20,000. She was released on bond on April 27.
A plea agreement was reached in Lathim’s case on July 23. Lathim pleaded guilty to one count of unlawful sexual conduct with a 16- or 17-year-old, amended from a first-degree felony to a third-degree felony, and one count of dealing in materials harmful to a minor, a third-degree felony. The court dismissed the two first-degree felony forcible sodomy charges without prejudice.
A presentencing investigation report will be completed before Lathim is sentenced.
Lathim has been ordered to have no contact with the teenage victim, either directly or indirectly. She has also been ordered to have no unsupervised contact with minors, other than her own minor children and grandchildren. Lathim was additionally order to undergo a psychosexual assessment and, if the therapist recommends it, a subsequent sexual evaluation.
The state agreed to recommend no more than 120 days of jail service for Lathim when she is sentenced, with the possibility of in-home confinement using electronic monitoring, according to court documents.
Lathim is scheduled to be sentenced on Oct. 15.
