ST. GEORGE – Two St. George men were arrested early Friday morning on an array of charges after witnesses reported the truck they were in was stopping at green lights, driving into oncoming traffic and swerving all over the road. One of the men, a convicted sex offender, was also charged with failure to register the truck under the sex offender registration requirements.

Around 12:45 a.m. Friday, officers were dispatched to an “Attempt to Locate” bulletin issued for a pickup truck “traveling all over the roadway” westbound on Red Hills Parkway, according to a probable cause statement written by St. George Police Officer David McDaniel in support of the arrest.

Witnesses reported the truck would speed up then slow down, go into oncoming traffic, and almost hit the curb on both sides of the road as it traveled all over the two-lane roadway, the statement said. One witness continued to follow the truck to call out its location.

At the Red Hills Parkway and Bluff Street intersection, the truck stopped for a green light and stayed stopped for 15-20 seconds before proceeding through the light, according to the statement.

Officers finally caught up to the truck on Snow Canyon Parkway.

“I stayed behind the vehicle and observed it slow down to under 20 mph, then speed up to around 40 mph erratically,” McDaniel wrote in the statement. “It moved back and forth across the fog line and into the inside lane by over 4 feet. I observed the truck almost strike the curb on 2 more occasions before slowing down.”

Officers activated emergency lights and attempted to stop the truck at 1650 W. Snow Canyon Parkway but the truck continued on and did not stop until around 1795 W. Snow Canyon Parkway.

When officers talked to the driver, identified as 20-year-old Dillon Legrand Spilsbury, and the passenger, identified as 53-year-old Alvie Jared Grover, they could smell a “strong odor associated with an alcoholic beverage” coming from inside the truck, according to the statement. Both men allegedly had glossy, bloodshot eyes and slurred speech.

“Both Dillon and Alvie swayed in place while sitting in the vehicle,” McDaniel wrote.

When officers asked Spilsbury to step out of the truck, the statement said, his balance was poor and he almost fell over several times. Spilsbury failed his field sobriety tests, and officers also discovered he had a suspended driver’s license for alcohol.

Grover was removed from the vehicle and almost fell over several times, McDaniel said. Grover was found to have allowed Spilsbury to drive his truck. Grover was also discovered to be a convicted sex offender and he had allegedly failed to register the vehicle under the sex offender registration requirements.

Both men were arrested and booked into the Washington County Purgatory Correctional Facility.

Spilsbury was charged with five class B misdemeanors for driving under the influence of alcohol, unlawful minor consumption of alcohol, alcohol restricted driver, reckless driving and driving on a suspended license. He was also charged with three infractions for failure to operate within a single lane, impeding traffic and entering an intersection without sufficient space.

Judge Douglas Whitlock, of the 5th District Court, ordered Spilsbury’s bail for his release pending trial at $5,110 during a video arraignment Friday. Spilsbury is scheduled to make his next court appearance Monday.

Grover was charged with a third-degree felony for failure to register as a sex offender, a class C misdemeanor for intoxication, and an infraction for allowing an unlicensed person to drive.

Fifth District Judge Eric A. Ludlow ordered Grover’s bail set at $5,000 during his initial court appearance Friday. Grover was found indigent by the court and will be represented by court-appointed attorney Douglas Terry. His next court appearance is scheduled for Tuesday.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
