SALT LAKE CITY — A lawsuit filed last week by Utah internet provider XMission accuses a Florida company of spamming more than 100,000 XMission email addresses. The lawsuit is asking a federal court to award XMission more than $60 million in damages.
The lawsuit was filed against Clickbooth.com, an internet marketing company based in Florida, accusing them of violating the federal Can-Spam act and sending unwanted emails to XMission customers. Xmission’s lawsuit claims that Clickbooth.com procured email addresses of their customers and spammed them.
XMission is seeking $100 for every email address on every count in the lawsuit and seeks treble damages, which if granted could exceed $60 million.
Fox 13 News in Salt Lake City interviewed XMission CEO Pete Ashdown Thursday, who said, “We have reached our limit as far as how much money and resources we put into blocking their efforts and how they don’t play by the rules.”
Ashdown also said to Fox 13 News, “If we go after one, then maybe others will take notice as well.”
