Trespasser arrested for meth, weapon possession

ST. GEORGE — Police arrested a 21-year-old man Sunday after responding to a trespassing call, and finding a man in possession of methamphetamine.

At 2:20 p.m., officers of the St. George Police Department responded to a residence on 1400 North after getting a call about a trespasser on the premises, Officer Doug Iverson wrote in a probable cause statement supporting the arrest.

Once on scene, the officers identified the trespasser in the residence as Seth Cox of St. George.

Officer Iverson attempted to have Cox step outside to speak with him, but Cox said he did not have to speak with police and he was there to get his stuff, the statement said.

When police told him he was not allowed to be at the residence, Cox said he would come outside in a minute and tried to shut the door.

“I pushed the door open and grabbed his left hand as he attempted to run,” Iverson said in the statement. “He attempted to pull away and a clear glass pipe (fell) from his right hand and hit the floor, partially breaking.”

Police then placed Cox under arrest, handcuffed him and sat him down in the kitchen, Iverson said. Officers then spoke with the owner of the home, who said Cox was not allowed there, and wanted him off the property.

While searching Cox, police found a small plastic baggie containing a white crystal substance in the right coin pocket of his pants, Iverson said in the statement. Officers also found a silver stainless steel vial of a white powdery substance, hanging around Cox’s neck.

Drugs were not the only prohibited item found on Cox, St. George Police Sgt. Sam Despain said. Inside his front right pocket, police also discovered a large knife, which was illegal for Cox to have at the time because he was also carrying illegal drugs.

“Because he was in possession of drugs that makes him a restricted person,” Despain said. “You can’t be a restricted person be in possession of a weapon.

The charge for carrying a weapon while in possession of drugs is the same regardless of the weapon type, Despain said.

The area where Cox was found is also considered a drug-free zone, Despain said, meaning the drug charges were enhanced by one degree. It was also discovered that Cox had a $560 cash-only warrant for his arrest for failure to appear in court regarding misdemeanor traffic violations.

Cox was arrested and booked into the Washington County Purgatory Correctional Facility. He is charged with one second-degree felony for possession of methamphetamine in a drug-free zone, and two class A misdemeanors for possession of a weapon by a restricted person and drug paraphernalia.

Cox’s bail for release on these charges was originally set for $13,900 but this amount has been cleared by judicial order, according to the current booking information, and is now set at $2,500. His $560 cash-only warrant still stands.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
