ST. GEORGE – St. George Police arrested a man on felony drug charges, outstanding warrants and interfering with an arrest Thursday night after the man resisted arrest and attempted to flee from officers.
At about 9 p.m., a mountain bike patrol officer encountered Brian Kunde, 41, of St. George, at 351 W. Tabernacle. According to a probable cause statement filed by Officer Seth LeFevre in support of the arrest, dispatch informed LeFevre that Kunde had outstanding warrants. At that point, LeFevre informed Kunde that he was under arrest.
“While making contact with Brian to tell him he was under arrest, I observed him reaching for items in his short pockets,” LeFevre wrote in the statement. “I advised Brian he was under arrest for the warrants. Brian immediately started to resist as I attempted to physically place him in handcuffs.”
Additional officers had arrived on the scene to render aid. Kunde pulled away from LeFevre’s grasp and tried to run, according to the statement, but other officers were able to detain him.
“After a short struggle, Brian was placed in handcuffs,” LeFevre wrote in the statement. “In the immediate area of the arrest suspected drugs and paraphernalia were located on the ground.”
Methamphetamine, three different types of pills and paraphernalia were found, according to the statement. The drug and paraphernalia charges have been enhanced because Kunde was within 1,000 feet of Southwest Adult High School.
Kunde was arrested and transported to the Washington County Purgatory Correctional Facility, where he was charged with two second-degree felonies and two class A misdemeanors for drug possession, one class A misdemeanor for possession of paraphernalia, one class A misdemeanor for failure to stop at the command of an officer, once class B misdemeanor for interfering with an arrest, and two outstanding warrants.
At the time of this publication, Kunde is still in custody and is being held on $29,300 bail.
Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.

I thought Southwest High School was like any other business since it’s privately owned an operated with a business license from the City of St George. That almost seems like they could enhance the charge cause your within 1000 feet of McDonalds if you ask me.
Short pockets? Not long pockets?
