Cedar City man arrested for burglary, assault while violating protective order

CEDAR CITY – Cedar City Police responded to a report of a fight occurring Sunday morning on the 1200 South block of Interstate Drive. When officers arrived they found 22-year-old Gilbert Luther of Cedar City inside the home of another man, assaulting him.

“Luther had gone to the home looking for an adult woman who he thought was residing in the home; this woman also had a protective order against Luther,” Sgt. Jimmy Roden of the Cedar City Police Department said. “When Luther arrived at the home, he entered the residence unlawfully and assaulted an adult man who resided in the home.”

Cedar City Police could not confirm if Luther and the man inside the home knew one another. However, Cedar City Police said that because Luther went into the home, entered unlawfully, and committed an assault, he was charged with burglary.

In addition, because he went to the home with the express purpose of looking for the woman who had the protective order against him, he was also charged with a protective order violation.

“Officers on scene also found he was intoxicated and that he had driven to the scene,” Roden said. “So Luther was also charged with driving under the influence.”

Luther was arrested and booked into the Iron County Correctional Facility on burglary, a third degree felony; assault and driving under the influence, both class-B misdemeanors; driving on a denied license and intoxication class-C misdemeanors; and a protective order violation a class-A misdemeanor.

Iron County Correctional Facility confirmed Tuesday morning that bail was set at $9,443. They also confirmed that Luther posted bond Monday evening and was subsequently released from custody.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
