Assault on 3 people leads to felony burglary charge

ST. GEORGE – St. George police arrested Arn Stucki, 27, of St. George, Sunday morning on charges of burglary after he went looking for another man he had an altercation with the previous night.

According to a probable cause statement, Stucki proceeded to a home in St. George, and when the homeowner opened the door, Stucki allegedly grabbed him by the shirt and punched him.

The homeowner’s wife came into the front room to see what was happening, and Stucki allegedly grabbed a large glass pitcher sitting on a nearby hutch, lifted it into the air and threatened her with it.

A third man then entered the room, and Stucki allegedly grabbed him by the back of the hair and began shaking him. During this altercation, a ceramic decoration was knocked to the floor and broke.

Stucki later denied assaulting the people living in the home. The homeowners told the responding officer that they do not know Stucki and had never met him prior to the incident.

Though no items were stolen, Stucki received one second-degree felony burglary charge. Utah state code states that when an individual enters or remains unlawfully in a building or any portion of a building with the intent to commit a felony, theft, lewdness, sexual battery, voyeurism or, in this case, an assault on a person, they can be charged with a felony burglary offense. Burglary is enhanced from a third-degree felony to a second-degree if the alleged crime was committed in a home.

In addition to the burglary charge, Stucki received three class-B misdemeanor assault charges and one class-B misdemeanor criminal mischief charge. He was booked into Washington County’s Purgatory Correctional Facility on $13,503 bail. As of Wednesday at 6:50 p.m., Stucki had not posted bail and was still in custody at Purgatory Correctional Facility.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
