ST. GEORGE – A St. George woman has been arrested for allegedly instigating the fight that occurred Sunday night between a group of approximately 15 people near the Skimboard Park on 2700 E. Waterfront Drive in St. George.

Heather Hill Mccleery, 30, was arrested on Monday and charged with Utah Code 76-9-101, causing a riot – a third-degree felony – after several witnesses identified her as the person who instigated and called more people on the phone to join the fight, which resulted in several people physically injured during its course.

According to the probable cause statement filed by St. George Police Officer Hector Dominguez in connection with the arrest, a witness said he had seen a “blonde lady,” later identified as Mccleery, yelling at a group of guys, while another witness claimed to have seen Mccleery bring a bat out of her vehicle, matching the information dispatch had given about a bat being used to hit someone in the face.

“When I arrived on scene, I noticed that there was a male laying on the ground who appeared to have a concussion,” Dominguez said in the statement. “(The victim) was limp and almost unconscious, having trouble understanding simple questions, date, time, location and whereabouts.”

The man was transported to Dixie Regional Medical Center.

Another man, who was hit in the face with a tire iron during the fight, leaving him with a “big swollen eye” and laceration, said he and his family and friends were at the park when Mccleery and her friends started calling them derogatory names such as “spics” and “beaners” and yelling that immigration was coming for them, the charging documents said.

The man said he did not know who hit him, as everything happened so fast, but that he did know Mccleery had caused the fight to break out, Dominguez wrote in the statement. He said he recognized Mccleery because he used to work with her ex-husband.

According to the probable cause statement, a third victim, who witnesses said was on the ground getting kicked in the head, told officers that before the actual fight happened, he overheard Mccleery calling people on the phone to “come fight the Mexicans.” He said at first it was a small group, and then it turned into a large group as people started to arrive in cars.

After having dispatch run the description and receiving information from witnesses, Dominguez said a positive match came back for Mccleery, along with the vehicle, which witnesses said she was driving when she left the scene, being registered in her name.

Officers searched for Mccleery through Sunday night and were able to locate her the next day around 4:30 p.m. at 1294 S. Bloomington Drive in St. George while she was dropping off her kids.

“I made contact with Heather and before any questions were asked I read her Miranda Rights,” Dominguez said. “Heather stated she did not want to talk to me and she wanted a lawyer.”

Mccleery was arrested and booked into Washington County’s Purgatory Correctional Facility. According to booking information, her bail stands at $10,000.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.

The “Mexican” issue surrounding this story is very interesting considering I recognize her as a waitress that works at Don Pedro’s Restraurant.

  • Chuck Brown June 24, 2014 at 9:13 pm

Good for her, I hope they slap her with some time….I bet her ex-husband has some not so nice things to say about her and their lost marriage.

  • Mark June 24, 2014 at 10:13 pm

I thought she looked familiar, pretty sure I will not see her at Don Pedro’s, and so much for the comments about Hispanics and gangs.

She looks so proud of herself in her booking photo

Why are the women of Utah so out of control? The Quorum should do something about all these crazy females. BTW you people posting where she works, you need to get a life because you are d bags.

    • Nofrowntown June 25, 2014 at 7:19 pm

Speaking of d bags that need to get a life, how about focusing on the victims and the seriousness of the news story and not the author and her pics!

…*…I wish I knew where you worked . I would put you on blast too! The Quorum Of the 12? They are …*. They don’t respect civil rights. If your going to post on Saint George news you better own it instead of supporting hypocrisy….You must be LDS.

Also. Sorry to get off the subject, but Kimmy, your selfies are starting to freak me out. You used to look good, and now you look like a cartoon character in a crazy B movie. A little too much air brushing maybe.

I’m glad this women was booked. Shame on her for causing this racisit incident. I hope they make her pay for everyone’s medical expenses. And i cant believe people came to the park to fight ? A park really ? And did anyone think that maybe it is a bad idea there might be children there? I hope they get charged too.

  • JOSH DALTON June 25, 2014 at 9:18 am

IRONIC….She just so happens to be my favorite waitress at Don Pedros the Mexican place in Green Valley. Hmmmmmm….

  • That's all!? June 25, 2014 at 10:15 am

She should get a whole lot more then a riot charge!!!

    • EL JEFE June 26, 2014 at 8:44 am

Agree with you there THAT’S ALL?, at the very least she should have been charged with a hate crime as well. By the way, being charged with a hate crime falls under the jurisdiction of the FBI, as it is considered a federal law.
If a gay person, or an African-American is assaulted because they are gay or black, THAT is a hate crime. “Come fight the Mexicans” sounds like it would
qualify as a hate crime. Current charges should be amended to include a hate crime. Come on County Attorney Belnap….put up or shut up. DO YOUR JOB!!! you so diligently claim you do for the people of this county. Now prove it!!!!

  • Sweet Jude June 25, 2014 at 10:48 am

Too many women in this town who are like her. They look prissy on the outside, but inwardly their hearts are raging full of anger at the slightest act (or perceived act) of provocation. I wouldn’t doubt if half of the lousy, no-good, masculine yet childish hooligans in this town were involved in some sort of controversy like this one.

  • there should be more June 25, 2014 at 11:07 am

I might be wrong but couldn’t this fall under hate crime as well?

  • JOSH DALTON June 25, 2014 at 11:41 am

I will still eat at Don Pedros once a week. The Steak Sizzling Fajitas are the best in town! I always feel satisfied when I leave that Mexican place. Her behavior in no way reflects the service or experience that Don Pedros offers! To hell with Panchos the food sucks! Don Pedros is walking distance from the house. So I am able to drink as much Negra Modelo as I want.

    • EL JEFE June 26, 2014 at 8:49 am

As long as you don’t trip and/or fall on your walk home after a few Modelos….otherwise it IS considered “drunk in public”, and could land you in the slammer. Where is Panchos located?

  • Mark June 25, 2014 at 2:51 pm

The last picture of Kimmie I did not like only because it was kind of blurry, you go girl.

  • nomo June 25, 2014 at 5:25 pm

What a purty lil trashy lady!

  • Brian June 26, 2014 at 2:51 pm

Wow if she would have made those comments about muslims, blacks or gays she’d have the FBI charging her for a hate crime. Sad that by not charging her with a hate crime the SGPD is brushing her racist comments and actions under the rug. An example should be made. You could argue the “riot” was a result of race so why are we missing additional charges?

  • sandra June 27, 2014 at 5:22 am

Did you people forget about innocent until proven guilty??!! She shouldn’t get the charges in the first place. She’s not the one that started it. Or started the “racist” comments. Or the one who brought the weapons in the first place. This is what happens when the 10 people who jumped them get together and make up a story. Don’t judge when you don’t know!

  • lp June 27, 2014 at 8:13 pm

“Innocent until proven guilty” is a crock of horse manure and we all know it……

  • Mark June 27, 2014 at 8:58 pm

Sandra, you are full of crap various people heard her, and they are white, yeah those people all made it up and beat themselves up, SHUT UP!

  • coeds December 15, 2014 at 8:00 pm

Well i also think she should be charged with a hate crime. Maybe we should all tell Mr. Belnap this. Since he does work for us
