Tony Hymas, 22, was arrested and charged with two third-degree felonies for unlawful sexual activity with a minor, and three class-B misdemeanors for drug possession, drug paraphernalia, and contributing to the delinquency of a minor.

According to the probable cause statement filed in connection with the arrest, the arrest stems from an investigation after authorities were alerted to a welfare check in the area of the 2700 block of W. 5900 North in Cedar City. It was reported that a 14-year-old girl was home alone and when the girl’s grandparent had gone by the residence, there was a car in the driveway.

Iron County Cpl. Jeff Humphries responded to the residence.

When the 14-year-old girl opened the front door, Humphries discovered Hymas at the residence as well. Humphries informed them that he could smell the distinct odor of marijuana coming from the residence. Humphries asked them if they had any marijuana in their possession and Hymas stated that they had smoked it all.

When the girl took Humphries to the back room to show him where they had used marijuana, Humphries located JB rolling papers, a small marijuana blunt on the bed, and a condom wrapper on the floor next to the bed, according to the statement.

When questioned, Hymas and the girl both admitted that they had engaged in sexual relations. Hymas also stated he had brought the marijuana for the two to smoke.

Hymas was booked into the Iron County Jail. According to booking information, Hymas’ bail stands at $10,000.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.

This stupid 14 year old girl lied and told Tony that she was 17! Yet she doesn’t get in trouble for lying, how is that justice? Girls need to be responsible too and not lie through their teeth to get older guy’s attention. Obivously she was smoking weed too, did she get in trouble for that, probably not!

Hey, you might at least learn a bit about spelling. Since you obviously cannot think, maybe you could memorize. It is anonymous, dummy.

    • anonimous May 28, 2014 at 2:49 pm

SHUT UP who cares if i can spell or not! that’s not the point here! my point is girls are just as stupid and slutty and should be in trouble for lying about their age when it gets a guy who thinks he is doing something innocent gets in trouble. I know this case and she never said what her real age was.

Utah law clearly states that mistake of age is not a defense! 14 or 17 what difference does that make??? He’s still 22 which makes him at least 5 years older than her. Or lets put it this way… He was in 12th grade when she was in 7th grade. Liar or not, he’s in the wrong!

so if a girl lied to you and said she was 18 and you had sex with her and then you got in trouble for it because she lied and you were facing felony charges how would you feel about this girl??? I know Tony PERSONALLY you don’t even know anything about this case which is why the news shouldn’t even be allowed to make an … out of tony and make you stupid people think less of him when he is a good guy!!!
