On the EDge: Zero tolerance for zero tolerance policy

OPINION — Like the current administration, I, too, have a zero tolerance policy.

I have zero tolerance for putting children in cages and anybody who thinks it is OK to do so.

I have zero tolerance for the kind of racism that zealously persecutes and prosecutes people of color for violation of a law that is considered a federal misdemeanor. In the grand scheme of things, this barely rises above an infraction. It is a waste of time, money and energy. The law and order freaks, however, would put these people away in a federal penitentiary for life, or at least aboard the next bus back to Anywhere, Mexico.

I have zero tolerance for this culture of willful ignorance that is celebrated by the inglorious minds that would binge watch “Duck Dynasty” or “Honey Boo Boo.” The dumbing down of America was underscored on Nov. 8, 2016, and while ignorance may not be bliss, it has become preferred and encouraged by the D-listers who comprise the administration and communicate in monosyllabic grunts, groans and Tweets. There is no elegance, no grace, no subtlety, just jackhammered discourse that ends, usually, with the words “I have a right to believe whatever I want to believe!” You can see how this “facts be damned” attitude adds nothing to the national dialog or moves the process forward.

That’s why it was no surprise last week when the president’s base lined up to support the lies about the policy that landed more than 2,500 children in detention centers.

First, the Democrats were blamed.

It was wrongly claimed that they had passed legislation to allow such practices.

The thing is, if anybody from the president on down had done their homework, they would have realized that no such law exists.

They blamed a law dealing with minors who show up at the border unattended – no parents or guardians – on Bill Clinton. The problem, of course, was that the law was passed by a Republican Congress and signed by George W. Bush in 2002.

To take the heat off, he then accused Democrats of flaming up the controversy of children detainees as a means to divert attention from his obsession with Hillary Clinton and the crimes he claims she committed.

Then, of course, when all else fails, blame Obama.

Except, there was nothing to pin on him, either.

No, this was policy formed by John Kelly and Jeff Sessions and approved by the president who all represent a party that claims a lock on family values. It was supposed to be a bluff, a deterrent, if Sessions can be believed; a warning to parents not to try to cross the border illegally.

Except, it was never given a chance to work and the bluff turned into reality when border cops started using the newfound policy to snatch kids from their parents and send them to detention centers, some being flown great distances away.

I guess the party of family values only stands up for those values if the family is the same color and comes from the same WASP neighborhood. Otherwise, they are out of luck, out of hope and out on the street.

And, now, the party of family values is beginning to line up behind the president and his suggestion that these families are undeserving of due process – one of the tenets of freedom and liberty. Without the protection of due process, we can only inch back to a frightening time when justice was meted out by lynch mobs dedicated, of course, to upholding the law even if, as is the case here, it is simply a misdemeanor offense. It is neither fair nor just, but it is expeditious so the president can ensure that the millions he claims are crashing our borders are taken care of swiftly.

That’s why we find ourselves in the middle of a humanitarian crisis.

We have seen his misogyny as the president supports men forced to resign from seats of power for their abuses against women – Roger Ailes, Rob Porter, Bill O’Reilly, Roy Moore and others – calling them “good men.”

We have seen him rise up to support white nationalists marching to spread their racist hate in Charlottesville, Virginia.

This business about building a wall along the southern border is an insult to our Mexican neighbors. It is also economic folly. No congressional body is going to approve funds for such massive moral and economic waste.

There is the diplomatic crisis of rejecting longstanding allies – not only Mexico, but neighboring Canada and our forever friends in Europe, Asia and elsewhere – while sidling up to a couple of vicious strongmen in Russia and North Korea, one of whom wants to annihilate the United States with nuclear weapons, the other desirous of fulfilling Nikita Khrushchev’s promise to bury the U.S. One hoodwinked the president during their recent summit in Indonesia, schooling him in real world terms about the art of the deal. The other gifted him with social media shenanigans that placed the keys to the Oval Office in his hands.

Over the last week or so we have seen a lot of comparisons with the Nazi concentration camps, but the truth is, the United States had concentration camps of their own.

During World War II, Americans were whipped into a racist frenzy that resulted in thousands from the Japanese, German and Italian communities being sent to concentration camps in the United States.

There were no trials.

There were no appeals.

There were no sentences, the detainees were just placed in custody.

Today, Americans have been whipped into a racist frenzy that has resulted in thousands from south of the border being sent to concentration camps in the United States.

There were no trials.

There were no appeals.

There were no sentences. The detainees are simply being placed into custody to await the filing of charges (maybe) and adjudication (maybe.) And, they have been separated from their children who have been shipped God knows where.

All because of a misdemeanor violation.

Such is the price of racism and hate.

No bad days!

            Its not about our opinions, its about the fact that it applies to everyone.

            Even the epitome of Conservative Constitutionalism, Anthony Scalia, makes this fact clear:

            “it is well established that the Fifth Amendment entitles aliens to due process of law in deportation proceedings.”

            The fifth ammendment states:

            “no person … shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.”

            Please learn some basic civics before exposing your ignorance and what is starting to appear to be a serious comfort with fascism.

            Ironically, under law, Trump can expedite deportation without a court or judge if 1) they aren’t seeking asylum (most are) and 2) they aren’t being criminally prosecuted (ie not under zero-tolerance policy).

            Oops, looks like Trump really stepped in a big mess. But most of us know that and have been highlighting his fascist tendencies for more than 2 years.

            Well, I suppose my mom and my husband working for the gov’t has tainted my thoughts of due process. All it is, is an appearance of telling your side of the story, in the name of due process. I suppose my whole idea of liberty and justice for all has turned into a complete joke and only words. There is no liberty, there is no justice.

            I suppose, I get bitter when people cry out about liberty and justice for illegals, when I’m standing here, as a US citizen that was pushed around, set up to fail, stolen from, and terrorized by our own government.

            Life isn’t fair. There is no Liberty and Justice for all. If there was, we would see alot more government officials being arrested.

            My opinions are based on facts of what happened to me. You cant find it in the Associated Press or fact check it, unless you dig deep and read the files against me. But I’m just one person, nobody has time for that. It’s easier to pretend it didnt happen then dig up the truth.

            Don’t know your personal history but it’s never a reason to weaponize the very thing you clearly hate against others. And make no mistake, Trump is intentionally wesponizing the angst of folks like you against the cornerstones of American democracy. And everyday you have a choice to support him or critique him.

          Why is it you have no idea what the law says about due process. They have enter here illegally and they are getting due process according to our laws.             Sorry you are a widow of a fallen police officer. I am pretty sure I have no maligned police officers in this conversation but if you show me I did not then I will admit my error.

            You are only partially right about Obama’s. Law dictates separating families if the parents are being criminally prosecuted. That was less common under Obama as he practiced what conservatives insulted as “catch and release”, similar to what Trump is ironically recommending now. So yes, some kids were separated from their parents but mostly repeat offenders or ones that posed a danger to their kids. The “caged” photos are mostly ones of unaccompanied minors who never had guardians to be separated from. That is a completely different issue than Trump’s “zero-tolerance” created humanitarian crisis that ran out of money almost immediately.

            Heads up, you are barking up the wrong tree if you think I didn’t call out Obama. I did. To my liberal friends’ dismay I challenged his saintly image on the regular before his 2nd term hence calling out Ed here and even agreeing with Hyde.

            I have cited the actual law and I’m fully aware of it. Show me where I am wrong with citations and I’ll admit I’m wrong. Until then I’ll rightfully stand on pretty solid ground.

      Not inherently, but focusing an inhumane immigration policy only on the southern border when we know its not the principal source of illegal immigration is racist. Trump has a habit of focusing Immigration policy on people of color and scapegoating them. He doesn’t even try to disguise it.

          Definitely not to blame for everything. Hell, despite predictions to the contrary, I’ll applaud him for maintaining and strengthening our economy. I have no problem applauding him if his negotiations lead to the denuclearization of North Korea. But that’s because I don’t have any allegiances to party politics. I care more about the truth, even when it means seeing the positives of someone I consider a lowly as Trump. Though for now the truth is highlighting his inhumane demogaugary. And that tendency is a sincere threat to democracy/liberty at large.

    I agree with much of what Ed says regarding this ill-advised policy. He did open up one big door to criticism though:

    Obama put kids in cages as well, it was just largely groups of “unaccompanied minors” and those children separated from parents deemed dangerous or worthy of prosecution beyond a misdemeanor. But Ed used zero-tolerance language and it comes with consequences. Did he spend considerable time calling out Obama for that transgression?

        The Obama administration actually expanded the system of detaining families – typically mothers and their minor children – after a huge surge of Central Americans along the U.S.-Mexican border in 2014. The policy resulted in many minors being detained in various locations, in much-criticized conditions, either with their families or by themselves, if they had crossed the border alone.

        Videos and photos at the time showed children in tears, many of them still wearing dirty clothes, in detention facilities where they were kept with their families. The conditions — which ranged from six adults and children sleeping crammed on two mattresses laid out on concrete floors, to sick minors not receiving medical care — were documented in many news accounts and reports by human rights groups.

        At the time, Obama administration officials argued they had no choice but to implement policies intended to deter families from entering the U.S. illegally. Trump administration officials have made similar arguments.

    Right. . . Ed. Obama never did any of this. By the way, did you see the good news today? The Supreme Court ruled in favor of President Trump’s travel ban vs. the liberal judge from Hawaii. Chief Justice John Roberts wrote for the majority that admission and exclusion of foreign nationals is a “fundamental sovereign attribute exercised by the Government’s political departments largely immune from judicial control. The president has extraordinarily broad discretion under 8 U.S.C. § 1182(f) to exclude aliens when he believes doing so is in the nation’s interests.”

    So. . . what does this have to do with Ed’s weekly rant? It looks like this ruling has just laid the foundation for construction of the border wall. Finally.

      I wasn’t aware the legality of constructing a border wall was ever challenged. My understanding the conversation has always been about Congress passing such a measure and funding, ie a question of the wisdom of doing so.

    Because of American Compassion from the Reagan Amnesty Act of 1986 until now, we have 11 – 21 Million Illegal aliens already here….so Nope, no more, I guess you all who think everyone who crosses the border gets their day in court, may want to read about “Expedited Removal of illegal aliens” which has been in place for many many decades…if that person is caught within 100 miles of the border, and hasn’t been in the USA longer that 14 days…Bye Bye! here’s just a taste of that law, from Wikipedia: Expansion to a 100-mile border zone and all people within 14 days of arrival (2004)[edit]

    In 2004, the United States Department of Homeland Security published an immediately effective notice in the Federal Register expanding the application of expedited removal to aliens who are encountered within 100 miles of any land or sea border and who entered the U.S. without inspection less than 14 days before the time they are encountered.[2] U.S. Customs and Border Protection could therefore identify possible immigration violators anywhere in this 100-mile border zone and process them for expedited removal if they had been in the country for less than 14 days.

    The notice clarified that, as a matter of prosecutorial discretion, the DHS would apply the expansions only to:
    1.third-country nationals (not from Mexico or Canada)
    2.Mexican or Canadian nationals with histories of criminal or immigration violations, such as smugglers or aliens who have made numerous illegal entries.

    It also indicated that officers could exercise discretion not to commence expedited removal proceedings based on individual equities.

    Rollout of expansion to border zone[edit]

    Due to resource constraints, the expansion of expedited removal to the entire border zone did not happen immediately. The implementation was done in three phases:[2]
    1.Initially, the DHS implemented expedited removal against aliens in the Tucson (Arizona), McAllen (Texas), and Laredo (Texas) Border Patrol Sectors.
    2.In September 2005, expedited removal was expanded to all nine Border Patrol Sectors along the southwest border.
    3.In March 2006, it was announced that expedited removal had been implemented in the entire border zone.

      1). That is considered due process only if

      (A)They aren’t seeking asylum (most are) and
      (B) Being prosecuted (ie zero-tolerance policy disqualifies them for the option)

      And its also interesting that Trump and his cronies are now advocating catch and release options after a few years of insulting Obama for it. Its almost like Trump’s only policy was based on misunderstanding the entirety of the federal government.

    Democrats have very little regard for law unless it benefits them. If these illegals were high achievers and likely Republicans, the Dems would want to enforce the immigration laws.
    As it is, most illegals are poor and want entitlements, hence potential Democrats.

    Ed, simple question the mother or father has broken the law, here in the USA. And when American Mom or Dad do that, they fo to jail. What happens to the kids. They immediately taken to foster care. They are not left with aunts and uncles, they are a ward of court. The court than decides who they are safest with. That is the law. It is there to protect children, from being placed with drug addict auntie, uncle etc. So why would we treat illegals children any differently? People bringing in children who are not their parent is up 314%. I am sure you have heard that report, but you ignore it. Let’s face facts, the talking points went out a few weeks ago and the democratic party decided to run to the border, even though they never went, and never spoke up when this was going on under the Obama Administration. Next fact in order to be qualifed for refugee status, A refugee, as defined by Section 101(a)(42) of the Immigration and Nationality Act (INA), is a person who is unable or unwilling to return to his or her home country because of a “well-founded fear of persecution” due to race, membership in a particular social group, political opinion, religion, or national origin. It is not because your country is poor, you have drug wars going on, your husband is abusing, etc. This requires folks to go to ports of entry. Not sneak in. The Bill that Bill Clinton signed was if they has come in illegally, before they were not allowed to enter for ten years, the majority of these people are repeater, like the two year old’s mother. I am sorry you hate our laws and our President, I am sorry we working to stop illegals from voting. But as Bill, Obama and Hillary used to say this is nation of laws. And they all had very strong statements against illegal immigrants. You folks will change your tune for whatever serves you. Thank God for a Constitution that is very clear. Too bad the liberals have taken over the schools and aren’t teaching our children this subject. But trust me we will be.

      Refugees and asylum seekers are different and have different policies.

      Obama did separate families when the parent(s) were being prosecuted but it wasn’t the norm as most were processed through the maligned “catch and release” policy.

      Families of legal citizens are only separated under dire circumstances. Its not conmon.

      Most Congressional Democrats did not call Obama for his immigration policy but many liberals did, including myself.

      The general claim about illegals voting is bogus and fact checked as false. Its propoganda from Trump to rile up his base.
